Terms of sale

1. Definitions used in the document

• J Brew S.r.l.: company; with registered office in Via Villapizzone 26 | 20156 – Milan – Italy - VAT number 08396940960. 
• Jbrew.it is; the virtual shop through which it is; It is possible to purchase the Products. 
• General Conditions: these are the present general conditions of sale and any future new versions that may be published on jbrew.it. 
• Customer: any subject (natural or legal person) who purchases one or more Products through jbrew.it, accepting the General Conditions. 
• Parties: J Brew S.r.l. and the Client, jointly. 
• Purchase and Sale Agreements: the purchase and sale agreements for the concluded Products, pursuant to art. 3. which follows, between J Brew S.r.l. and Customers through jbrew.it. 
• Products: the products published on jbrew.it which may form the subject of a future Purchase Agreement. 
• Price: the sale price of the Products as indicated on jbrew.it in correspondence with the Products themselves. 
• Order: the purchase order for the Products sent by the Customers, in accordance with the to the General Conditions and following the procedure referred to in art. 6 which follows. 
• Order Confirmation: the e-mail message through which J Brew S.r.l. informs Customers of acceptance of the Order.

2. Object

2.1 The General Conditions regulate all the Sale and Purchase Agreements, constituting an essential and integral part thereof.
2.2 J Brew S.r.l. reserves the right to modify the General Conditions at any time, it being understood that those published on jbrew.it at the time the Customer sends the relative Order will be considered applicable to each Purchase Agreement.
2.3 In the event of contrast between the rules referred to in the General Conditions with any other specific rules relating to the Sale and Purchase Agreement, provided that they are published on jbrew.it, the latter will apply.

3. Conclusion of the Sale and Purchase Agreement

3.1 J Brew S.r.l. undertakes to send the Customer the Order Confirmation within 2 working days of receipt of the relative Order by the Customer.
3.2 The Sale and Purchase Agreements are understood to be concluded between the Parties when the Customer receives the Order Confirmation, regardless of his actual knowledge (without prejudice to the right of withdrawal pursuant to article 9, in the cases provided therein). If the Customer does not receive the Order Confirmation within the term indicated in art. 3.1, which means will have to to be understood as a silent refusal and therefore the relative Order must be be considered rejected by J Brew S.r.l. and therefore devoid of any legal effect.
3.3 By sending the Order, the Customer declares to have read all the instructions relating to the modality; of purchase of the Products referred to in art. 6 and to have fully accepted the General Conditions as well as the that I have read all the additional information contained on jbrew.it, also referred to via links.
3.4 Each Order will be processed. archived in the database of jbrew.it, according to the modalities; and in compliance with the provisions of Legislative Decree 06.30.2003 n. 196 ("Privacy") and will be accessible by contacting J Brew S.r.l. to the references referred to in art. 15.

4. Availability of the Products

4.1 The type of Products published on jbrew.it and their availability are: they may vary at any time without this affecting you. does not involve any responsibility; for J Brew S.r.l. towards customers.
4.2 Products indicated as "not available" cannot be ordered by Customers. In case of unavailability occurrence of a Product indicated as available at the time the Order is sent by a Customer, J Brew S.r.l., without prejudice to the provisions of art. 3.2, undertakes to indicate to this Customer, in a subsequent communication by e-mail, the indicative times foreseen for a new availability; of the Product(s) object of the Order sent by the Customer. The Client can collect the Order within 48 hours of receiving such communication from J Brew S.r.l. (without prejudice to the right of withdrawal pursuant to art. 9, in the hypotheses provided therein) by sending an e-mail message to the address specified in art. 15. In this case J Brew S.r.l. undertakes to reimburse the Price in the shortest possible time.
4.3 J Brew S.r.l. reserves the right to not to indicate availability; of some Products published on jbrew.it.

5. Price and shipping

5.1 The price is the same. expressed in € (EUR). The applicable price is the one published on jbrew.it at the time each Order is sent by the respective Customers.
5.2 The Price is inclusive of VAT (22%).
5.3 The Price does not include shipping costs. The Client is therefore required to pay J Brew S.r.l. a contribution for shipping costs of 8€ for each shipment, excluding the case in which “free shipping” (as happens for orders over 100€).
5.4 The contribution provided for in the preceding paragraph will be however indicated, separately from the Price of the Product on jbrew.it yes; that the Customer knows it before sending any related Order and it will be paid by the Customer, in the event of conclusion of the Sale and Purchase Agreement together with and at the same time as the payment of the Price according to the methods pursuant to art. 7.
5.5 The Products will be delivered only within the territory of the Italian State.

6. Mode for sending Orders

6.1 In order to be able to place Orders on jbrew.it, the Customer must enter all the data requested therein as "mandatory" in the appropriate section, including their tax code pursuant to article 14 of law 189 of 8 November 2012 namely the “prohibition of the sale of alcoholic beverages to minors”.
6.2 The Customer may purchase the Products by selecting them directly from the jbrew.it product sheet and placing them in the "cart". If the Products that the Customer intends to purchase are more than of one, the same procedure as above should be done. be repeated by clicking on "continue shopping". Once the choice of Products has been completed, the Customer must, if he has not already done so, provided previously, proceed to enter your data as per art. 6.1 and then click on "continue". Once the correctness of the data relating to the chosen Product/s and of the "shipping information" has been verified, the Customer will be able to proceed to send the Order by clicking on "place the order".

7. Mode of payment

7.1 J Brew S.r.l. reserves the right to to vary, at any time, the means of payment that can be used by the Customers, it being understood that those published on jbrew.it will be considered usable at the time the Orders are sent by the respective Customers.
7.2 J Brew S.r.l. will send by e-mail to customers with a regular VAT number invoice (against the complete supply of company data). For the purposes of issuing the invoice, the information provided therein by the Customer will prevail: no variation of the invoice will be accepted. possible after its issuance by J Brew S.r.l.
7.3 The information received by J Brew S.r.l., pursuant to this article 7, will be used exclusively to complete the procedures relating to the sale of the Products and for the reimbursement procedures in case of exercise of the right of withdrawal pursuant to art. 9. by Customers.

The Customer will be able to make the payment of the Price and the contribution for the shipping costs referred to in art. 5 through two methods:

PayPal

Payment via PayPal will be processed. made in favor of J Brew S.r.l.
At the conclusion of the order on jbrew.it, the Customer is directed to the PayPal login page.
The amount relating to the order is debited from the PayPal account at the of the acquisition of the order.

In case of cancellation of the order, both by the Customer and in case of non-acceptance of the same by J Brew S.r.l., the amount will be paid. refunded to the Customer's PayPal account within 30 days. from the date on which Brew S.r.l. it is having become aware of the cause that generates the right to a refund.
Once the transaction has been canceled, under no circumstances Brew S.r.l. can be held responsible for any damages, direct or indirect, caused by delay in the failure to release the amount committed by PayPal.

At no time during the purchase process does Brew S.r.l. é able to know the Client's financial information. Since there is no data transmission, there is no data transmission. the possibility; that this data is intercepted. No computer archive of J Brew S.r.l. contains, nor; keep these data.

For each transaction made with the PayPal account, the Customer will receive a a confirmation email from PayPal.

Credit card

In cases of purchase of the goods with formality; of payment by Credit Card, the transaction will be processed. guaranteed by the PayPal circuit to which you will be able to pay. redirected at the same time as the order is closed.

J Brew S.r.l. reserves the right to to ask the Customer for additional information (e.g. landline number) or to send copies of documents proving the ownership of the contract. of the card used. In the absence of the required documentation, J Brew S.r.l. reserves the right to not to accept the order.

In no case will J Brew S.r.l. can therefore be held responsible for any fraudulent and undue use of credit cards by third parties when paying for products purchased on jbrew.it.

8. Shipping and delivery times

8.1 For "shipping" of the Products by J Brew S.r.l. pursuant to this contractual regulation, delivery of the same to the courier is understood. Once the payment has been received, J Brew S.r.l. undertakes to ship the Products within the following times: (i) in the case of available Products (as defined in Article 4.): within 5 working days; (ii) in the case of available Products which have become unavailable (as defined in art. 4.2): within 5 working days from the moment in which such Product or such Products are available again at the J Brew S.r.l. warehouses, without prejudice to the Customer's right to collect the Order pursuant to the same art. 4.2.
8.2 J Brew S.r.l. guarantees the shipment of the Products by express courier (GLS or other). The Products are shipped by J Brew S.r.l., and delivered by the Courier, to the address indicated by the Customers when entering the data pursuant to art. 6.1 or to a different address indicated when the Order was sent.
8.3 Pursuant to the law, J Brew S.r.l. will complete the delivery of the Products at the time of their respective delivery to the Courier, but will do everything in its possibilities so that the Products shipped pursuant to articles 8.1 and 8.2 are delivered by the courier within the terms indicated in the "Shipping" section.
8.4 The delivery terms pursuant to art. 8.1, cannot, in any case, be considered binding for J Brew S.r.l. which cannot in any case be held responsible for their non-compliance.
8.5 Customers, or other subjects appointed by Customers who are at the address indicated for the delivery of the Products in the Order Confirmation, are required to verify, at the time of delivery, that: (i) the Products correspond to what is indicated in the transport document (DDT) of the Courier both by number and by type; (ii) the packaging/package of the Products is intact, not damaged, wet or otherwise altered, even in the closing materials.
8.6 Any damage to the packaging/packaging of the Products must be immediately contested by the Customer by affixing a written control reserve on the Courier's proof of delivery. It is understood that, once the Courier's document has been signed without any objection, the Customer will no longer be able to raise any objection to J Brew S.r.l. with reference to the delivered Product.
8.7 The Products can be delivered by the Courier only to the Customers or to persons authorized by them; the person to whom the Products are delivered must affix a signature to certify the delivery. The Courier does not deliver to post office boxes or by placing the Products in letterboxes or other similar places.

9. Right of withdrawal

9.1 If the Customers are "consumers" (i.e. a natural person who acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out), the Customers have the right, pursuant to and for the purposes of art. 64 of Legislative Decree no. 206/2005, to withdraw from the Sale and Purchase Agreements within 14 working days from the date of receipt of the Products covered by the Sale and Purchase Agreements. The right of withdrawal must be exercised by customers by sending J Brew S.r.l. a written communication, by e-mail to the address referred to in art. 15., containing:
(i) the willingness to exercise the right of withdrawal;
(ii) the indication of the Order that gave rise to the Sale and Purchase Agreement from which they intend to withdraw.
9.2 In case of exercise by the Customers of the right of withdrawal pursuant to this art. 9.:
(i) Customers undertake to return the Products within 7 working days from the date of the notice of withdrawal pursuant to art. 9.1;
(ii) all costs associated with returning the Products are entirely borne by the Customers;
(iii) J Brew S.r.l. undertakes to reimburse the Price in the shortest possible time, and in any case within 30 days from the date of receipt of the notice of withdrawal pursuant to art. 9.1, provided that:
- the Products have been returned and are intact;
- the original packaging/packaging of the Products is also returned and is intact;
- any accessories are also returned and are intact;
- the Products have not been used;
J Brew S.r.l. will communicate to the Customers the methods of reimbursement of the Price and may, for this purpose, ask the Customers for their bank details (IBAN and current account holder).
9.3 If the Customers exercise the right of withdrawal in a way that does not comply with the terms and conditions set out in this article 9, the Customers are not entitled to a refund of the Price.

10. Defects / discrepancies of the Products

"Consumer" Customers (as defined in Article 9.1) are entitled to the consumer's rights pursuant to Article 130 of Legislative Decree 206/05; these rights must be exercised within the terms of art. 132 of the same Legislative Decree 206/05.

11. Privacy

The data controller of the data collected through jbrew.it is J Brew S.r.l. which declares and guarantees that the Customers' personal data will be treated in compliance with the provisions of Legislative Decree 196/03, and subsequent amendments.
The persons responsible for the processing of customer data are the following:
- Paypal, as manager of online payment systems;
- GLS or other express courier that deals with the processing of data necessary to carry out the shipping, delivery and return of products purchased on jbrew.it.

12. Errors and/or inaccuracies on jbrew.it

12.1 J Brew S.r.l. undertakes to constantly check jbrew.it in order to avoid errors or inaccuracies. However, it is possible that jbrew.it contains or may contain errors, inaccuracies or omissions over time.
12.2 J Brew S.r.l. therefore reserves the right to correct errors, inaccuracies or omissions contained on jbrew.it even after an Order has been sent and also reserves the right to change or update information at any time without prior notice to Customers.

13. Intellectual Property

All intellectual property rights connected to jbrew.it (including the contents) are the exclusive property of J Brew S.r.l. jbrew.it and its contents may not be reproduced in whole or in part, transferred by electronic or conventional means, modified, connected and used for any purpose without the prior written consent of J Brew S.r.l.

14. Applicable law

14.1 The General Conditions and the Sale and Purchase Agreements are governed by Italian law (and in particular by Legislative Decree 206 of 06/09/2005 - which in articles from 50 to 67 regulates remote contracts - and by Legislative Decree 70 of 09/04/2003 on electronic commerce) and must be interpreted in the light of this.
14.2 For any controversy that may arise in connection with the General Conditions and/or the Sale and Purchase Agreements, the Court of MILAN (MI) will have exclusive jurisdiction, unless otherwise provided in mandatory form by law.
